This Privacy Policy explains how Moruk, LLC("we", "us", or "our") collects, uses, shares, and safeguards information when you use the Bird Lensmobile application, website, AI tools, support channels, and related services (collectively, the "Services"). We are registered in Wyoming, United States. If you have questions, contact us at hello@birdlens.app.
1. Information We Collect
- Information you provide. Email address, support messages, app settings, feedback, subscription or billing context handled through the app stores, bird photos, bird-song recordings, observation notes, text prompts, and any other information you choose to share.
- Uploads and AI inputs. Bird photos, bird-song recordings, observation details, and related metadata you submit to identification features such as Photo Bird ID and Sound Bird ID.
- Automatically collected information. Device type, operating system, app version, browser, IP address, coarse location such as country, usage events, diagnostic logs, crash reports, and security metadata.
- Cookies & similar technologies. See our Cookie Policy for details. We use cookies to improve your experience, analyze traffic, and understand user behavior. Optional analytics and marketing storage follows your consent settings and applicable regional defaults.
2. AI Uploads and Third-Party Content
When an identification feature accepts a bird photo or sound recording, that file may be sent to Bird Lens's backend and its configured AI provider to generate likely species suggestions. Providers act as processors for analysis, reliability, abuse prevention, and security. The current website tools provide field-identification checklists and do not require an upload.
We do not sell uploaded photos, recordings, observation notes, or AI prompts. We do not publish your observations or use uploads to train general-purpose AI models unless we ask for and receive separate permission.
Photos and recordings may include other people or reveal a sensitive wildlife location. You are responsible for having a fair reason and appropriate permission before uploading someone else's private content. Remove names, faces, voices, addresses, precise nest locations, and unrelated details whenever possible. Never disturb wildlife or disclose a threatened species' sensitive location to obtain an identification.
3. How We Use Your Information
- To operate and maintain the Services;
- To provide and personalize photo and sound identification guidance;
- To communicate with you, including updates and promotional messages (you may opt out);
- To monitor, analyse, and improve the Services and develop new features;
- To detect, prevent, and address technical issues or fraud;
- To comply with legal obligations.
4. Processors and Service Providers
We use service providers only where they help us operate, secure, measure, or improve the Services. Depending on the platform and feature, these providers may include:
- Hosting, infrastructure, and delivery: Vercel, Cloudflare, and Moruk infrastructure services.
- AI analysis: the Moruk AI gateway and configured AI model providers, as configured for photo or sound analysis.
- Analytics, attribution, and ads measurement: Google Tag Manager, Google Analytics, Google Ads, Google AdMob, PostHog, Vercel Analytics, Apple App Store, and Google Play.
- Diagnostics and crash reporting: Sentry and Firebase Crashlytics where configured in the app.
- Safety, bot protection, and notifications: Cloudflare Turnstile, Telegram notifications where enabled, and email delivery or support tooling.
5. Legal Basis for Processing (GDPR/UK GDPR)
We process your personal data under the following bases: (a) your consent; (b) performance of a contract; (c) legitimate interests; and (d) compliance with legal obligations.
6. Sharing Your Information
We do not sell your personal data. We share information with processors and service providers listed above, with app stores or payment providers when needed for subscriptions and purchases, with safety or legal authorities where required or permitted by law, and with your consent.
7. International Transfers
Your data may be processed outside the European Economic Area. Where this occurs, we rely on EU Standard Contractual Clauses or other lawful transfer mechanisms.
8. Data Retention
- AI uploads and request payloads: deleted from active analysis systems within 30 days unless retained longer for user support, safety review, abuse prevention, fraud investigation, debugging, or legal compliance.
- AI results and app history: retained while needed to provide the feature, sync saved results, or honor your app settings, then deleted or de-identified when no longer needed.
- Support messages and safety reports: generally retained for up to 24 months so we can resolve issues, track abuse patterns, and meet legal obligations.
- Analytics and diagnostics: retained according to provider settings, usually up to 26 months or less where configured.
- Transaction and legal records: retained as required for tax, accounting, dispute, compliance, or app-store obligations.
9. Your Rights and Data Deletion Requests
Depending on your location, you may have rights to access, rectify, erase, restrict, or object to processing of your personal data, and the right to data portability. To exercise these rights, contact hello@birdlens.app, or use our Support page. You can request deletion even if you do not have a Bird Lens account.
10. US State Privacy Rights
Residents of California and other US states with privacy laws may have rights to know, access, correct, delete, or receive a copy of personal information, and to opt out of sale, sharing, targeted advertising, or certain profiling. We do not knowingly sell personal information. Where advertising or analytics partners process data for cross-context behavioral advertising or targeted ads, you can opt out through Cookie Settings, supported Global Privacy Control browser signals, platform privacy settings, or by contacting us.
11. App Tracking Transparency and Ad Personalization
On iOS, Bird Lensrespects Apple's App Tracking Transparency controls. If the app asks for permission to track activity across other companies' apps or websites, you can allow or deny that permission and change it later in iOS Settings. On iOS and Android, you can also manage ad personalization and advertising identifiers in your device or app-store settings.
12. Security
We implement reasonable administrative, technical, and physical safeguards to protect your information. However, no Internet transmission is 100% secure.
13. Children's Privacy and Adult-Only Use
Bird Lens is intended for adults and is not directed to people under 18. We do not knowingly collect personal data from children. If you believe a person under 18 has provided us with personal data, contact us so we can review and delete it where appropriate.
14. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be notified via the app or email.
